(3) CB 1207-38– 1st Reading – Adopt the Proposed Ordinance closing a special construction fund entitled “Water and Sewer System Improvements Fund,” Fund 339, as established by Ordinance No. 2693-03 and amended by Ordinance No. 3039-07 (3rd and final reading on 8-8-12)

(4) Authorize the Call for Bids for the Powder MillGulch Tributary Stabilization Project

(15) CB 1207-36– 2nd Reading – Adopt the Proposed Ordinance rezoning the north portion of the property located at 3054 Tulalip Avenue from M-2 (Heavy Industrial) to R-1 (Single Family), amending Ordinance No. 1671-92 (3rd and final reading and public hearing on 8-1-12)

(16) CB 1207-37– 2nd Reading – Adopt the Proposed Ordinance approving a Comprehensive Plan map amendment to expand the City’s Urban Growth Boundary on Smith Island, amending Ordinance No. 2021-94, as amended (3rd and final reading and public hearing on 8-1-12)

CONSENT ITEMS:

(17) Adopt Resolution No. ____ authorizing claims against the City of Everett in the amount of $2,171,445.58 for the period of July 7, 2012 through July 13, 2012

(18) Authorize the closure of Wall Street, Hoyt to Colby, on September 15, 2012, 8 a.m. to 4 p.m., for a High Seas Pirate Day sponsored by the Imagine Children’s Museum

(19) Authorize the closure of Wall Street, Hoyt to Colby, on August 5, 2012, 8 a.m. to 4 p.m., for a Racin' Rally Day sponsored by the Imagine Children’s Museum

(20) Accept the Portal 3 Modification Project as complete and Authorize the Mayor to sign the Certificate of Completion with Razz Construction allowing the release of the retainage bond held by Berkley Regional Insurance Company

PUBLIC HEARING:

(21) CB 1207-263rd and final Reading – Adopt the Proposed Ordinance amending the Moratorium relating to the Central Waterfront Planning Area by extending the Moratorium an additional six (6) months, amending Ordinance No. 3260-12

ACTION ITEMS:

(22) Authorize the Mayor to sign the Washington State Office of Public Defensegrant application for the 2013 calendar year in the amount of $150,000 and, if the City is awarded a grant, to execute documents necessary to accept the grant and complete the transfer of funds

(23) Award RFP 2012-005 for NEC Telephone Network Maintenance to Black Box Networks Services in an annual amount of $105,325 including Washington State Sales Tax

(24) Adopt resolution declaring a 1994 Caterpillar 416B Backhoe (H0003) surplus and authorize it to be sold at a public auction to be conducted by the James G. Murphy Co.

(25) Authorize the Mayor to execute the Local Agency Standard Consultant Agreement for On-CallSurveying Services

(26) Authorize the Mayor to sign Amendment No. 7 to Professional Services Agreement with MacLeodReckord to extend the Agreement completion date to December 31, 2012

(27) Authorize the Mayor to sign Amendment No. 3 to the Professional Services Agreement with ICF Jonesand Stokes for the Smith Island/Union Slough Restoration Site Monitoring Services in the amount of $19, 955.00

(28) Authorize the Mayor to sign Amendment No. 1 to the Professional Services Agreement with AMEC Earth and Environmental for on-call environmental services for an additional $110,000.00

(29) Authorize the Mayor to sign the Professional Services Agreement with Tetra Tech Inc to provide Engineering Consultation Services for the Water Filtration Plant in the amount of $29,800.00

(30) Authorize the Mayor to sign Amendment Two to the Agreement with Dog DayAfternoon to use City property for concession services

(31) Authorize the Mayor to sign Amendment One to the Agreement with Fun Times Ice Cream to use city property for mobile concession services

(32) Authorize the Mayor to sign the Professional Services Agreement with GeoEngineers, Inc. to provide Geotechnical Consultation Services for the Parks & Recreation Department
